Welcome to OneSlurp ("we," "our," or "us"). By accessing or using the OneSlurp mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and OneSlurp. We reserve the right to modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the modified Terms.
OneSlurp is a mobile application that allows users to:

If you are under the age of 13 (or the applicable age of digital consent in your jurisdiction), your parent or legal guardian must review and agree to these Terms on your behalf. Parents and guardians are responsible for monitoring and supervising their children's use of the App.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
You retain all ownership rights to the content you post on OneSlurp, including reviews, ratings, notes, and any other user-generated content ("User Content").
By posting User Content, you grant OneSlurp a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:
This license continues even if you delete your account, as your reviews may remain visible to preserve the integrity of the review system.

You may upload photos of soups, restaurants, and related content ("Photos") as part of your reviews.

No Photo Moderation:
Photos are NOT pre-screened or moderated before posting. You may encounter Photos that are poor quality, irrelevant, not actually of the soup or restaurant claimed, offensive, or copyrighted material posted without permission. You acknowledge and agree that OneSlurp is not responsible for Photos posted by users.
Photo Removal:
We reserve the right to remove Photos at any time for any reason, but have no obligation to do so.
Photo Storage:
Camera and Photo Permissions:
The App will request permission to access your device camera and photo library. You can control these permissions in your device settings.
While posting reviews and Photos, you agree NOT to post content that:
IMPORTANT: OneSlurp does NOT actively monitor, review, or moderate User Content before it is posted. We do not pre-screen reviews, ratings, or any user-generated content. The ability to report content is available directly within the application and will notify administrators to review the specific content.
You acknowledge and agree that:
We reserve the right (but have no obligation) to remove or disable access to any User Content at any time, remove content that violates these Terms if we become aware of it, remove content in response to legal requests or court orders, or remove content at our sole discretion.
We are under no obligation to monitor User Content, remove any specific content, investigate complaints about content, or respond to content removal requests.
If you believe content (including Photos) violates these Terms or applicable laws, you may report it using the in-app reporting feature or by contacting us at oneslurp-app@proton.me. We will review reports but are not obligated to take action.
We are not responsible for loss of User Content. You are responsible for maintaining backups of your content.
You agree NOT to:
The App uses Google Places API to search for restaurants. Your use of location-based features is subject to Google's Terms of Service and Privacy Policy.
User data is stored using Supabase. By using the App, you acknowledge that your data will be processed according to Supabase's terms and privacy practices.
The App displays advertisements provided by Google AdMob. Ad delivery is subject to Google's advertising policies.
The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party sites.
The App uses your device's location to help you find nearby restaurants. Location data is used only for this purpose and is not stored permanently.
You can control location permissions through your device settings. Some features may not work if you deny location access.
The App, including its design, features, graphics, code, and content (excluding User Content), is owned by OneSlurp and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
ONESLURP IS NOT RESPONSIBLE FOR USER CONTENT. All reviews, ratings, and opinions posted by users are solely the responsibility of the user who posted them. We do not endorse, verify, or guarantee the accuracy of any User Content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONESLURP SHALL NOT BE LIABLE FOR:
This limitation applies regardless of the legal theory (contract, tort, negligence, etc.) and even if we have been advised of the possibility of such damages.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM.
ONESLURP IS NOT RESPONSIBLE FOR:

You agree to indemnify, defend, and hold harmless OneSlurp, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees) arising from or related to:
Your use of the App is also governed by our Privacy Policy and our End User License Agreement, which are incorporated into these Terms by reference.

We retain your data for as long as your account is active. Even after account deletion, your reviews and photos may remain visible to preserve the integrity of the review system.
The App displays advertisements provided by Google AdMob. By using the App, you agree to receive advertisements.
Ads may be personalized based on your interests and activity. You can control ad personalization through your device settings.
We do not endorse any products or services advertised in the App.
If you are under 13 years of age (or the applicable age in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian.
We do not knowingly collect personal information from children under 13 without parental consent. If we learn that we have collected information from a child under 13 without parental consent, we will delete it.

The App is controlled and operated from the United States. We make no representation that the App is appropriate or available in all locations. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
You may stop using the App at any time. You may delete your account by contacting us at oneslurp-app@proton.me or through the account deletion page.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, for any reason including violation of these Terms, fraudulent or illegal activity, extended inactivity, or at our sole discretion.
Upon termination:
These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at oneslurp-app@proton.me. We will attempt to resolve the dispute informally within 60 days.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
If we cannot resolve a dispute informally, you and OneSlurp agree to resolve any claims through final and binding arbitration, except as set forth below.

YOU AND ONESLURP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Neither you nor OneSlurp may participate in a class action, class arbitration, or other representative action.
If arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Lehigh County, Pennsylvania for the purpose of litigating all such claims.
These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and OneSlurp regarding the App and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
These Terms do not create any third-party beneficiary rights.
We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, or government actions.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App, updating the "Last Updated" date, and sending an email notification (if you have provided an email). Your continued use of the App after changes constitutes acceptance of the modified Terms.
